By accessing or using the PlaneSales website (planesales.com.au) and related services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
2. Description of Service
PlaneSales provides an online marketplace platform that connects aircraft buyers with sellers and dealers. We do not:
- Own, sell, or purchase any aircraft
- Guarantee the condition, safety, or legality of listed items
- Guarantee the accuracy of listing information
- Participate in transactions between users
We act solely as an intermediary to facilitate connections between parties.
3. User Accounts
Registration
Some features require account registration. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
Account Termination
We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our discretion.
4. Listing Guidelines
Dealers and users listing aircraft must:
- Provide accurate and truthful information
- Have legal authority to sell the listed aircraft
- Maintain current registration and airworthiness certificates
- Comply with all applicable aviation regulations
- Update or remove listings promptly when sold
Prohibited listings include stolen aircraft, counterfeit parts, and items that violate any laws.
5. Transactions
All transactions occur directly between buyers and sellers. PlaneSales is not a party to any sale. Users are responsible for:
- Conducting due diligence on aircraft and sellers
- Verifying all documentation and certifications
- Arranging inspections before purchase
- Negotiating and completing transactions
- Complying with all legal requirements for aircraft transfer
6. Fees and Payments
Certain services may require payment of fees. Current fee schedules are available on request. We reserve the right to modify fees with reasonable notice. Payments are non-refundable unless otherwise stated.
7. Intellectual Property
All content on PlaneSales, including text, graphics, logos, and software, is our property or that of our licensors. You may not reproduce, distribute, or create derivative works without written permission.
8. Limitation of Liability
To the maximum extent permitted by law:
- PlaneSales is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the fees paid by you in the preceding 12 months
- We are not responsible for the actions of users or third parties
9. Indemnification
You agree to indemnify and hold harmless PlaneSales, its officers, directors, employees, and agents from any claims, losses, or damages arising from your use of the service or violation of these terms.
10. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.
11. Changes to Terms
We may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the modified terms. We will notify users of significant changes via email or website notice.
